This Privacy Policy describes how The Midnight Garden LLC ("TMG," "we," or "us") collects, uses, and shares information when you visit our websites, submit forms on the websites of our managed clients, or receive messages from us on behalf of those clients.

TMG operates a client-services platform that powers websites, lead-capture forms, and operational notifications for the small businesses we serve. When you submit a form on a TMG-managed client site, your information is processed by TMG on behalf of that client.

Information We Collect

Information you provide

• Name, email address, phone number, and street or service address (when you submit a quote-request or contact form)
• Service details you describe in form fields or message bodies (e.g. moving job specifics, junk-removal scope, photos you choose to upload)
• Your stated preferred contact method and your explicit consent for SMS communication

Information collected automatically

• Standard web log data: IP address (processed transiently for security and rate limiting only; raw IP is not stored in TMG application content and is not included in form-notification emails), user agent, referrer, and pages visited
• Marketing attribution parameters from URLs (UTM, Google Click ID, Meta Click ID, Microsoft Click ID, Local Services Ads lead ID) so we can measure which channels work

How We Use Information

• To respond to your quote request and operate the service you contacted us about
• To send you confirmation, follow-up, and review-request messages by your chosen contact method
• To notify the relevant TMG client (the small business you contacted) so the owner can prepare a real reply
• To improve the funnel by analyzing which steps people complete and which they abandon
• To meet legal, security, and fraud-prevention requirements

SMS Messaging

If you select "Text" as your preferred contact method on a TMG-managed client form and explicitly check the consent box, you opt into SMS messages from us related to the request you submitted.

What you'll receive

• A confirmation message acknowledging your request
• Up to two follow-up messages (typically at 24 and 72 hours) if your request remains unbooked
• An internal escalation message routes to the TMG operator if the small-business owner has not acknowledged within 2 business hours
• If you complete a job with one of our clients, one review-request message after the job

Frequency, costs, opt-out

• Message frequency: Typically 1 to 5 messages per request. Varies based on your engagement.
• Message and data rates may apply. Charges depend on your mobile carrier plan; we do not control them.
• Opt out: Reply STOP to any message. We honor it immediately and stop sending you SMS for that consent record.
• Help: Reply HELP to receive contact information for support.
• Carriers are not liable for delayed or undelivered messages.

Mobile information sharing

We do not share, sell, rent, or transfer your mobile phone number or SMS opt-in data to third parties for their marketing or promotional purposes. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors that support our services -- such as the messaging-platform provider that delivers the SMS -- is permitted, and those providers are bound by confidentiality agreements.

Email

We send transactional email through our messaging provider (currently Resend) using the verified sender domain themidnightgarden.club. You can reply to any email to reach the person sending it. We do not enroll you in marketing email lists without explicit additional consent.

Photos You Upload

If a TMG-managed client form invites you to upload photos (for example, to size up a junk-removal job), those photos are stored at non-public, unguessable URLs that we share only with the client owner and our internal operators. Photos are not indexed, listed publicly, or sold. You can ask us to delete any photo you uploaded.

Information We Share

• The relevant TMG client. Your form submission is shared with the small-business owner or operator you contacted. This is the whole point of submitting the form.
• Service providers we contract with for hosting (Vercel), database (Neon), email delivery (Resend), and SMS delivery (Twilio). These providers process data only to deliver the service we hired them for.
• Legal authorities if compelled by law, subpoena, or to protect rights and safety.
• We do not sell your information.

Data Retention

Lead and message records are kept while the relevant client engagement is active and for up to 36 months after, for accounting and legal recordkeeping. You can request earlier deletion at any time.

Your Choices

• Opt out of SMS: Reply STOP to any text we send.
• Opt out of email: Reply to any email asking us to stop, or use the unsubscribe link if present.
• Access, correction, deletion: Email hmu@themidnightgarden.club with the request and we will respond within 30 days.
• Do Not Track: We do not currently respond to browser DNT signals because no consensus standard exists; we honor explicit opt-out requests instead.

Children

Our services are not directed to children under 13. We do not knowingly collect information from children under 13.

Changes

We update this Privacy Policy from time to time. Material changes will be flagged at the top of this page with a new "Last updated" date.
